Terms & Conditions

1 Acceptance of Terms

By accessing or using the AccessiTest platform, website, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you and AccessiTest, Inc.

2 Description of Services

AccessiTest provides automated and manual web accessibility testing tools, compliance reporting, CI/CD integrations, and related developer tools designed to help organizations achieve and maintain WCAG 2.0, 2.1, and 2.2 compliance. Our Services include but are not limited to:

  • Automated WCAG compliance scanning and auditing.
  • Screen reader simulation and assistive technology testing.
  • Color contrast analysis and design system validation.
  • Keyboard navigation and focus management testing.
  • VPAT, ACR, and custom compliance report generation.
  • API access for programmatic accessibility testing.

3 User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete registration information and to update it as necessary. You must notify us immediately of any unauthorized use of your account.

4 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services to scan websites or applications without proper authorization from their owners.
  • Attempt to reverse-engineer, decompile, or disassemble any part of our platform.
  • Use the Services to conduct denial-of-service attacks or overload our infrastructure.
  • Share your account credentials with unauthorized third parties.
  • Resell, sublicense, or redistribute our Services without written authorization.
  • Use the platform to collect personal data of third parties without their consent.

5 Subscription & Billing

Paid Services are billed on a subscription basis (monthly or annually) as selected during sign-up. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' prior notice. If you do not cancel before the next billing cycle, your subscription will automatically renew. Overdue invoices accrue interest at 1.5% per month.

6 Intellectual Property

All content, features, functionality, trademarks, logos, and source code of the AccessiTest platform are the exclusive property of AccessiTest, Inc. and are protected by international copyright, trademark, and intellectual property laws. Your use of the Services does not grant you ownership of any intellectual property rights in the platform or its content. You retain ownership of all data you upload to or generate through our Services.

7 Data Processing

When you use our Services to scan web pages or applications, we process the content of those pages solely for the purpose of generating accessibility reports. We do not store the full content of scanned pages beyond what is necessary to produce your audit results. Scan data is encrypted in transit and at rest. See our Privacy Policy for full details on data handling practices.

8 Service Level Agreement (SLA)

For paid subscribers, we commit to a 99.9% uptime guarantee for our core scanning and reporting services, measured on a monthly basis. Scheduled maintenance windows (communicated at least 48 hours in advance) are excluded from uptime calculations. In the event of an SLA breach, affected customers may request service credits as outlined in our SLA documentation.

9 Limitation of Liability

To the maximum extent permitted by law, AccessiTest and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Services. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim. Our Services provide testing tools and reports; they do not constitute legal advice or guarantee full regulatory compliance.

10 Termination

Either party may terminate the agreement at any time. You may cancel your account through your account settings or by contacting support. We may suspend or terminate your access if you violate these Terms or engage in activities harmful to our platform or other users. Upon termination, your right to use the Services ceases immediately. We will retain your data for 90 days after termination, after which it will be permanently deleted.

11 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in Wilmington, Delaware. Nothing in these Terms prevents either party from seeking injunctive relief in a court of competent jurisdiction.
